The CJI-led bench held that Sushmita Dev's petition, which was about inaction, had become infructuous because the Commission had decided all complaints. It said the merits of the clean chits could only be challenged in a fresh petition. Dev's additional affidavit had called the orders belated and inconsistent with action taken against other leaders.
