Challenge repeatedly listed and deferred through 2025

On 19 March 2025 the court deferred the case to 16 April; on 16 April a bench of Justices Surya Kant, Dipankar Datta and Ujjal Bhuyan fixed 14 May; on 14 October it was listed but not reached and posted to 11 November. On 7 November, asked to choose between the appointments case and the SIR challenge for the 11 November slot, Bhushan chose SIR.

What happened on 14 May 2025 was not found. The 2026 reference order describes the plea for reference being raised after the matter had been pending about two years.
