Jaya Thakur petition challenges Sections 7 and 8 of the 2023 Act

Madhya Pradesh Mahila Congress general secretary Dr Jaya Thakur petitioned the Supreme Court, the same day the Act came into force, arguing the Act dilutes the Anoop Baranwal judgment and threatens free and fair elections. ADR, PUCL, Lok Prahari, Gopal Singh and Naman Sherstra filed connected petitions during 2024.

The March 2024 order records that the petition was sub judice from 2 January 2024. Tribune (March 2025) also names TMC MP Mahua Moitra among the petitioners; her petition number is not in the 2026 judgment's cause title.
